Welcome to The Purpose Plant. These Terms of Service ("Terms") govern your use of thepurposeplant.com (the "Site") and your purchase of any products from The Purpose Plant LLC ("The Purpose Plant," "we," "us," or "our"), a Florida limited liability company. By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can use the Site

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

2. Our products

We sell live plants, and every plant is a living thing. Size, shape, coloring, and pot style may vary from the photos on the Site — natural variation is part of what you're buying, not a defect. Plant photos are representative of the species and general size you will receive.

Each plant ships with a meaning card. Meaning descriptions, stories, and traditions shared on the Site and on our cards are offered in the spirit of gift-giving and cultural tradition. They are not promises of outcomes.

Wellness notes are not medical advice. Some product pages mention general wellness qualities of plants (for example, air quality or mood). These are general statements about houseplants and are not medical, psychological, or health advice, and are not claims that any plant will treat, cure, or prevent any condition.

Plants and safety. Some plants are toxic to pets or people if ingested. Safety information on our product pages is provided for convenience, but you are responsible for keeping plants away from children and animals and for verifying safety for your household. If ingestion occurs, contact a medical or veterinary professional immediately.

3. Gift orders and card messages

Many of our orders are gifts. When you provide a recipient's name and address, you confirm you have the right to share that information with us for delivery purposes.

You may include a personal message on the meaning card. You agree that your message will not contain anything unlawful, threatening, harassing, defamatory, obscene, or hateful. We reserve the right to decline to print a message that violates this standard (we will contact you for a replacement message before shipping).

4. Pricing and payment

All prices are in U.S. dollars. We do our best to keep pricing and availability accurate, but errors happen; if a product is listed at an incorrect price or a plant becomes unavailable after you order, we may cancel the affected order and will refund you in full. Payment is processed at checkout through our payment providers. Applicable sales tax is calculated at checkout.

5. Shipping and delivery

We currently ship only within the United States. Shipping costs, timelines, and weather-related practices are described in our Shipping Policy, which is part of these Terms.

You are responsible for providing a correct, complete delivery address. Once a package is marked delivered by the carrier to the address you provided, delivery is complete. Live plants should be unboxed promptly; we are not responsible for decline caused by a package left unopened or unattended after delivery.

6. The Happy-Plant Promise (returns and refunds)

Live plants cannot be returned like ordinary goods, so we stand behind them instead:

Arrives damaged: if your plant arrives damaged or in poor condition, contact us within 7 days of delivery with photos and we will send a free replacement or issue a full refund.
Declines early: if your plant declines within 14 days of delivery despite reasonable care following the included care guidance, contact us within that window with photos and we will send a free replacement or issue a full refund.

Whether we replace or refund is decided case by case at our reasonable discretion. Full details, including cancellations and non-plant items, are in our Refund Policy, which is part of these Terms.

7. Your account and conduct

You agree to use the Site only for lawful purposes. You will not attempt to interfere with the Site's operation, probe or breach its security, scrape its content at scale, place fraudulent orders, or misrepresent your identity. We may refuse service or cancel orders where we reasonably suspect fraud or abuse.

8. Intellectual property

The Site and everything on it — the name The Purpose Plant, our wordmark, meaning card designs, product stories, photography, page designs, and copy — belong to us or our licensors and are protected by intellectual-property laws. You may not copy, reproduce, or use them commercially without our written permission. You're always welcome to share links to the Site and to post photos of plants and cards you purchased.

9. Third-party services

The Site may contain links to, or operate with, third-party services (for example, payment processors and shipping carriers). We are not responsible for the content or practices of third parties, and your use of their services is governed by their own terms.

10. Disclaimer of warranties

Except for the Happy-Plant Promise described above, the Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of your order or use of the Site will not exceed the amount you paid us for the order giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law, and some states do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at hello@thepurposeplant.com and give us 30 days to try to resolve the issue informally — most issues are fixed with a replacement plant or a refund. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Florida, and both parties consent to their jurisdiction. Either party may instead bring an individual claim in small claims court.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Changes apply to orders placed after the change is posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and us regarding the Site and your orders.
